B Seen LLC, an Indiana limited liability company (“BSeen,” “we,” “us,” or “our”), wants you to be familiar with how we collect, use, and disclose information. This Privacy Policy describes our practices in connection with information that we collect online and offline:

  • through the BSeen mobile application (the “App”);
  • through our website at the URL associated with the App (the “Website”);
  • through social media properties from which you are accessing this Privacy Policy (“Our Social Media”);
  • through HTML-formatted email messages, push notifications, or text messages that we send to you (“Communications”);
  • through the recruiting, content-sharing, and discovery services we provide (“Services”); and
  • through any other offline business interactions you may have with us (“Offline Interactions”).

Collectively, we refer to the App, the Website, Our Social Media, Communications, Services, and Offline Interactions as the “Services.” This Privacy Policy is incorporated into and forms part of the BSeen Terms of Service. Capitalized terms used but not defined in this Privacy Policy have the meanings given to them in the Terms of Service.

IMPORTANT NOTICE TO PARENTS AND LEGAL GUARDIANS

BSeen is designed to make athlete content publicly discoverable by college coaches, university recruiters, and other users of the Services. This is the central purpose of the Services. As a result:

  • Children under the age of 13 are not permitted to create an account or use the Services. We do not knowingly collect personal information from children under 13. See “Children’s Privacy and COPPA Compliance” below.
  • Minors aged 13 through 17 may use the Services only with the express, verifiable consent of a parent or legal guardian, who must accept the Terms of Service and this Privacy Policy on the minor’s behalf and assume legal responsibility for the minor’s use of the Services.
  • Content uploaded to the Services—including videos, images, performance data, and profile information—is intended to be visible to other users, including coaches, recruiters, and the public. Users should not upload anything they wish to keep private.

Parents and legal guardians are strongly encouraged to read this Privacy Policy in full before permitting any minor to use the Services.

COLLECTION OF PERSONAL INFORMATION

“Personal Information” is information that identifies you as an individual or relates to an identifiable individual. The categories of Personal Information we may collect through the Services include:

  • Identifiers and contact information: name, username, email address, mobile telephone number, and postal address;
  • Account credentials: password (stored in hashed form) and security questions;
  • Profile information: date of birth, age, gender, height, weight, school or club affiliation, graduation year, sport, level of competition, position, jersey number, coach contact information, and similar athlete profile data;
  • Athletic content: competition videos, photos, audio recordings, scoring data, statistics, performance metrics, achievements, and tags applied to such content;
  • Communications data: messages, comments, reports, and other content you send to or through the Services;
  • Parental or guardian information: for users who are minors, the name, email address, mobile telephone number, and (where required for verifiable parental consent) government-issued identification or payment card information of the consenting parent or legal guardian;
  • Recruiter and coach verification information: for users registering as college coaches, recruiters, or program representatives, institutional email addresses, employer or program affiliation, position title, and similar verification data;
  • Government-issued identifiers: only where collected from a parent or legal guardian for the limited purpose of verifying parental consent or identity, in which case we delete the information promptly after verification (see “Children’s Privacy and COPPA Compliance” below);
  • Biometric identifiers (such as facial templates derived from a parent’s photo ID and live image): only where collected for the limited purpose of verifying parental consent or identity, in which case we delete the underlying images and derived templates promptly after verification; and
  • Payment information: if and when paid features are introduced, we will collect billing information through a third-party payment processor; we do not currently collect or store full payment card numbers.

We and our service providers collect Personal Information in a variety of ways, including:

Through the Services

We collect Personal Information when you create an account, set up your profile, upload content, send messages, follow other users, contact us, or otherwise interact with the Services.

From a Parent or Legal Guardian

For users who are minors, we collect Personal Information from the consenting parent or legal guardian as necessary to verify consent and to administer the minor’s account.

Automatically

We collect certain information automatically when you use the Services, as described under “Other Information” below.

From Other Sources

We may receive Personal Information from other sources, including publicly available databases and social media platforms (where you elect to connect a social media account to your BSeen account).

We need to collect Personal Information in order to provide the Services to you. If you do not provide the information requested, we may not be able to provide the Services. If you disclose any Personal Information relating to other people to us or to our service providers in connection with the Services, you represent that you have the authority to do so (including, where the other person is a minor, the consent of that minor’s parent or legal guardian) and to permit us to use the information in accordance with this Privacy Policy and the Terms of Service.

USE OF PERSONAL INFORMATION

We and our service providers use Personal Information for legitimate business purposes, including:

  • Providing the Services. To create and maintain your account; to allow you to upload, post, and share content; to make athlete content discoverable by college coaches and recruiters using the Services; to enable messaging, following, tagging, and other interactive features; and to process any payments (when applicable).
  • Verifying parental consent and identity. To obtain and verify the consent of a parent or legal guardian where required, and to verify the identity of users who hold themselves out as coaches, recruiters, or program representatives.
  • Communicating with you. To send administrative messages such as account confirmations, security alerts, changes to terms or policies, and responses to your inquiries.
  • Personalizing the Services. To suggest other users to follow, surface relevant content, and tailor the experience based on your sport, level, and stated preferences.
  • Improving the Services. To analyze usage trends, debug issues, develop new features, and otherwise improve the Services. We use only de-identified or aggregated data for these purposes whenever feasible.
  • Safety, trust, and integrity. To detect, prevent, and respond to fraud, harassment, abuse, objectionable content, intellectual property violations, security incidents, and violations of the Terms of Service; and to comply with our zero-tolerance commitments under the Terms of Service.
  • Legal and regulatory compliance. To comply with applicable law, court orders, lawful requests from public authorities, and our legal obligations; to enforce the Terms of Service; and to protect the rights, privacy, safety, or property of BSeen, its users, or others.

We do not use children’s Personal Information for behavioral or targeted advertising. We do not sell children’s Personal Information. We do not use children’s Personal Information to train artificial intelligence or machine learning models, except for limited internal model training related to safety, content moderation, fraud prevention, and the integrity of the Services.

We do not engage in automated decision-making that produces legal or similarly significant effects concerning users. Automated systems are used to assist with content moderation, recommendations, and search functionality, but final decisions on account suspension or content removal in response to reports are made or reviewed by BSeen personnel.

DISCLOSURE OF PERSONAL INFORMATION

We disclose Personal Information as follows:

To Other Users and the Public

The Services are designed to make athlete content discoverable. By design, your username, profile information, athletic content (videos, images, scores, performance data), tags, comments, follower and following relationships, and similar profile-level information are visible to other users of the Services and, depending on your settings and the nature of the content, may be visible to the general public, including search engines. You should have no expectation of privacy in this content. See the Terms of Service for additional detail.

To Service Providers

We disclose Personal Information to third-party service providers that perform services on our behalf, including providers of: cloud hosting and storage; video transcoding, streaming, and content delivery; analytics; customer support; email, SMS, and push notification delivery; identity verification and parental consent verification; payment processing (when applicable); and security, fraud prevention, and content moderation. These service providers are contractually required to use Personal Information only as necessary to perform services for BSeen and to maintain appropriate confidentiality and security safeguards.

For Legal and Safety Reasons

We may use and disclose Personal Information when we believe in good faith that disclosure is necessary or appropriate to: comply with applicable law, regulation, subpoena, court order, or other legal process (including outside your country of residence); cooperate with law enforcement or government authorities; enforce the Terms of Service or this Privacy Policy; protect the rights, privacy, safety, or property of BSeen, our users, or others; or detect, prevent, or address fraud, security, or technical issues.

In Connection With Corporate Transactions

We may disclose Personal Information in connection with a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar transaction. In such an event, we will require the recipient to honor this Privacy Policy with respect to your Personal Information, or we will provide notice and obtain any consents required by law.

With Your Consent

We may disclose Personal Information with your consent, or, in the case of a minor, with the consent of the minor’s parent or legal guardian.

We do not sell Personal Information for monetary consideration. We do not share Personal Information for cross-context behavioral advertising. We do not disclose children’s Personal Information to third parties for advertising, monetization, or AI training purposes.

OTHER INFORMATION

“Other Information” is any information that does not reveal your specific identity or does not directly relate to an identifiable individual, such as:

  • Browser, mobile device, and operating system information (e.g., device type, model, operating system name and version, screen resolution, language, browser type and version, App version);
  • Information collected through cookies, software development kits (SDKs), pixel tags, mobile advertising identifiers (when permitted by your device settings), and similar technologies;
  • Approximate location derived from IP address;
  • Server log information, including the date and time of visits, pages and screens viewed, and features used; and
  • Information that has been aggregated or de-identified such that it no longer reasonably identifies you.

If we are required to treat Other Information as Personal Information under applicable law, we will use and disclose it for the purposes for which we use and disclose Personal Information as described in this Privacy Policy.

Cookies and Similar Technologies

We use cookies and similar technologies to operate the Services, remember your preferences, authenticate sessions, measure usage, prevent fraud, and improve performance. You can control cookies through your browser settings. Disabling cookies may affect the functionality of the Services.

Analytics

We use analytics services, which may include Google Analytics or comparable products, to help us understand how the Services are used. These services may use cookies and similar technologies to collect information about use of the Services. We do not permit our analytics providers to use children’s Personal Information for behavioral advertising or for any purpose other than the internal operations of the Services. You can learn about Google’s practices at google.com/policies/privacy/partners and opt out by installing the Google Analytics opt-out browser add-on at tools.google.com/dlpage/gaoptout.

Do Not Track

We do not currently respond to “Do Not Track” signals from web browsers because no uniform industry standard for such signals has been adopted.

CHILDREN’S PRIVACY AND COPPA COMPLIANCE

BSeen takes the privacy of children very seriously and complies with the Children’s Online Privacy Protection Act of 1998, as amended, and the Children’s Online Privacy Protection Rule (“COPPA”), as amended by the Federal Trade Commission and effective for compliance as of April 22, 2026.

No Use by Children Under 13

The Services are not directed to children under the age of 13, and we do not permit children under 13 to create accounts or use the Services. We use a neutral age screen at registration to identify users under 13 and prevent account creation. If we learn that we have collected Personal Information from a child under 13 without verifiable parental consent, we will promptly delete that information. If you believe we may have collected Personal Information from a child under 13, please contact us immediately at the address listed in the “Contacting Us” section below, and we will investigate and respond promptly.

Mixed-Audience Service

Because the Services are likely to attract some users who are under 13, BSeen treats the Services as a “mixed-audience” service for COPPA purposes. Before collecting any Personal Information from a user, we ask the user to provide their date of birth through a neutral age screen. We do not encourage users to falsify their age, and we do not retain age information from users we determine to be under 13 except as necessary to prevent the same individual from creating an account.

Direct Notice to Parents

In the limited circumstances in which we may collect Personal Information from a child under 13 (for example, if a parent or legal guardian wishes to enroll a child under 13 in a future feature designated by BSeen as eligible for parent-managed accounts), we will provide direct notice to the parent or legal guardian containing the information required by COPPA, including: (a) that we have collected the parent’s online contact information from the child for the purpose of obtaining consent; (b) the categories of Personal Information we propose to collect from the child; (c) the specific purposes for which we propose to collect each category of Personal Information; (d) the identities or specific categories of any third parties to whom we propose to disclose the Personal Information and the specific purposes of those disclosures; (e) any internal use of the child’s Personal Information for automated decision-making or profiling (BSeen does not engage in automated decision-making with respect to children); (f) that the parent’s consent is required for the collection, use, and disclosure of the information; and (g) the means by which the parent can provide verifiable consent.

Verifiable Parental Consent

Where we collect Personal Information from a child under 13, we obtain verifiable parental consent before such collection, using one or more methods reasonably calculated, in light of available technology, to ensure that the person providing consent is the child’s parent or legal guardian. Approved methods we may use include:

  • signed consent form returned by mail, fax, or electronic scan;
  • use of a credit card, debit card, or other online payment system that provides notification of each separate transaction to the primary account holder;
  • toll-free telephone call to trained personnel;
  • video conference with trained personnel;
  • verification of a government-issued photo identification, with deletion of the identification promptly after verification;
  • matching of a parent’s government-issued photo identification to a live image of the parent using facial recognition technology, with deletion of both images and any derived templates promptly after verification;
  • knowledge-based authentication using dynamic, multiple-choice questions of sufficient difficulty;
  • text message coupled with an additional confirming step, such as a follow-up text, letter, telephone call, or email (the “text-plus” method); and
  • email coupled with an additional confirming step (the “email-plus” method), used only where the child’s Personal Information will be used solely for internal purposes and not disclosed.

Separate Consent for Third-Party Disclosure

Where applicable, we will obtain a parent’s separate verifiable consent before disclosing a child’s Personal Information to any third party in a manner that is not integral to providing the Services. We do not disclose children’s Personal Information for monetary consideration, advertising, or training of artificial intelligence systems.

Parental Rights

A parent or legal guardian who has provided verifiable consent has the right, at any time, to:

  • review the Personal Information we have collected from the child;
  • refuse to permit further collection or use of the child’s Personal Information;
  • require us to delete the child’s Personal Information; and
  • revoke consent previously granted, in which case we will terminate the child’s account and delete the child’s Personal Information except as required to be retained by law.

To exercise any of these rights, a parent or legal guardian may contact us using the information in the “Contacting Us” section below. We may need to verify the identity of the requestor before acting on any such request.

Minors Aged 13 Through 17

For users aged 13 through 17, BSeen requires verifiable consent from a parent or legal guardian who must also accept the Terms of Service and this Privacy Policy on the minor’s behalf. Although COPPA does not require parental consent for users 13 and over, BSeen extends comparable consent and notice protections to minors under 18 due to the nature of the Services. The parent or legal guardian retains the right at any time to review information associated with the minor’s account, request changes or deletion, and terminate the minor’s account.

SECURITY

BSeen maintains a written information security program designed to protect Personal Information against unauthorized access, use, disclosure, alteration, and destruction. The program includes administrative, technical, and physical safeguards appropriate to the size and complexity of BSeen’s operations and the sensitivity of the data involved. As required under the amended COPPA Rule with respect to Personal Information collected from children, our written information security program for children’s Personal Information includes designation of personnel responsible for the program, periodic risk assessments, implementation and testing of safeguards, and oversight of service providers that handle children’s Personal Information.

Despite these measures, no system of data transmission or storage can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure (for example, you suspect your account has been compromised), please notify us immediately as described in the “Contacting Us” section below.

RETENTION AND DELETION

We retain Personal Information only for as long as reasonably necessary to fulfill the purposes for which it was collected, to comply with applicable legal and regulatory obligations, to enforce the Terms of Service, to resolve disputes, and to protect against fraud and abuse. We do not retain children’s Personal Information for longer than reasonably necessary to fulfill the purpose for which it was collected, and we do not retain children’s Personal Information indefinitely.

When Personal Information is no longer needed for the purposes described in this Privacy Policy, we will delete it or de-identify it in a manner that prevents it from reasonably being associated with you. Notwithstanding the foregoing, content you have made public on the Services (including videos, images, and other User Content) may persist on the Services or in the hands of other users, third parties, or search engines after deletion of your account. See the Terms of Service for additional detail.

CHOICES AND ACCESS

Marketing Communications

You may opt out of marketing-related emails or text messages by following the unsubscribe instructions in any such message or by contacting us at the address listed in the “Contacting Us” section below. Even if you opt out of marketing communications, we may still send you administrative messages relating to your account or the Services, from which you cannot opt out.

Push Notifications

You can disable push notifications at any time through the settings of your mobile device.

Access, Correction, and Deletion

You may request to review, correct, update, suppress, delete, or object to or restrict processing of Personal Information we hold about you, or request to receive an electronic copy of your Personal Information, by contacting us at the address listed in the “Contacting Us” section below. We will respond consistent with applicable law. For your protection, we may need to verify your identity before fulfilling your request. Some Personal Information may need to be retained for legal or legitimate business reasons, in which case we will inform you of the basis for retention.

Account Closure

You may close your BSeen account at any time through in-App settings or by contacting us. Closure of an account will trigger deletion of associated Personal Information consistent with the Retention and Deletion section above.

SENSITIVE INFORMATION

Other than information collected from a parent or legal guardian for the limited purpose of verifying parental consent (which is deleted promptly after verification), we ask that you not send us, and you not disclose, any sensitive Personal Information through the Services, including without limitation Social Security numbers, financial account numbers (other than as necessary for any future paid features), information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometric or genetic characteristics, criminal background, or trade union membership.

THIRD-PARTY SERVICES AND LINKS

This Privacy Policy does not address, and we are not responsible for, the privacy, information, or other practices of any third parties. The Services may include links to third-party websites or services and may permit you to connect third-party services (such as social media platforms) to your BSeen account. The inclusion of a link or integration does not imply endorsement of the linked site or service by us or our affiliates. We are not responsible for the information collection, use, disclosure, or security practices of other organizations, including Apple, Google, Meta, X, YouTube, TikTok, or any other operating system provider, social media platform provider, app provider, wireless carrier, or device manufacturer, including with respect to any Personal Information you disclose to such organizations through or in connection with the Services. Please review the privacy policies of any third-party websites or services you use.

ADVERTISING

BSeen does not currently display third-party advertisements within the Services. We do not engage in cross-context behavioral advertising of children, and we do not permit our service providers to use children’s Personal Information for advertising purposes. If we introduce advertising in the future, we will update this Privacy Policy and, where required by law, obtain appropriate consent.

PAYMENTS

We do not currently collect payments through the Services. If we introduce paid features, payments will be processed through a third-party payment processor, and we will not store or collect full payment card numbers. We will update this Privacy Policy to reflect any such changes.

INTERNATIONAL USERS

BSeen is based in the State of Indiana, in the United States of America, and the Services are intended for use by users located in the United States. If you access the Services from outside the United States, your Personal Information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those of your jurisdiction. By using the Services, you consent to such transfer, storage, and processing. You are responsible for compliance with the laws of your jurisdiction.

UPDATES TO THIS PRIVACY POLICY

The “Last Updated” legend at the top of this Privacy Policy indicates when it was last revised. We may update this Privacy Policy from time to time. If we make material changes, we will provide notice through the Services or by other reasonable means before the revised Privacy Policy takes effect. Where required by law, we will obtain your consent (or, in the case of a minor, the consent of the minor’s parent or legal guardian) to material changes. Your continued use of the Services following the effective date of any revised Privacy Policy means you accept the revised Privacy Policy.
